In our lives, everyone has had a serious traffic accident at least once and ended up visiting a traffic accident law firm. I often hear customers say, “I have lived in Los Angeles for 30 years and Las Vegas for 5 years and have had many accidents, but this is the first time I have received such a large amount of compensation.” Usually, most traffic accident compensation is determined by three main factors: the degree of damage to the car, the degree of treatment for the injury, and the insurance limit, rather than the educational background or which law school you graduated from.
First, depending on the estimate, the amount of compensation for small contact accidents is usually low. Even if you consistently receive physical therapy two or three times a week, insurance companies often only try to pay a small amount of physical therapy fees to customers who receive physical therapy. These cases usually occur in parking lots, and even if you call the police, they usually do not come because it is on private property. Therefore, if a minor accident does not cause much pain, it may be wise to just fix the car. However, if your car is damaged due to a major accident, so the estimate is high or the car is scrapped, it can be a big factor in determining the amount of compensation for the other insurance company.
Second, it is determined by the degree of treatment for the injury. No matter how serious the traffic accident was, if you do not receive treatment, most insurance companies cannot provide compensation because there is no bill or record of the treatment. Also, if you give doctors or physical therapists the impression that you have gaps or are not in much pain because you do not go to treatment regularly, your compensation will be lower due to those medical records. Even if you have been a loyal customer for 30 years, the insurance company absolutely pursues only its own interests, so do not be deceived by well-packaged advertisements. After a traffic accident, receive systematic treatment through an emergency room, physical therapy (chiropractic), pain doctor, or surgery doctor, and hope that this will lead to good results in the future. Looking at a case where three people were involved in a car accident not long ago, the two of them received injections and received diligent treatment by seeing pain doctors, specialists and surgery doctors. After 9 months, they received $130,000 in compensation. The other person who was riding with them said that working at a hotel was more important and went to Cairo. He received $5,000 in compensation, and he complained about why he received so little compensation, but later, after explaining that the problem was that he did not receive treatment, he said that he really did not know that other people would receive that kind of compensation, and that he would work harder next time, and then they parted ways.
Third, the two things mentioned above are important, but no matter how many times your car has been damaged or you have been injured, if the other party's car insurance limit is low, everything will be covered by that limit.
In Nevada, the lowest legal limit is usually $25,000/$50,000. $25,000 applies if there is only one person to be compensated, and $50,000 applies if there are two or more people. Please note that even if there are 10 people, if it is $50,000, they will have to split the $50,000. Since most people have the lowest insurance limits or there are many uninsured drivers, we recommend that you add UM/UIM (uninsured/underinsured motorist coverage) to your insurance and have a higher limit to prepare for drivers with low or no insurance. Even those who received $130,000 received a larger portion of the compensation from the UM/UIM of the driver accompanying them, but if you post a minimum of $25,000/50,000, you always end up paying only $70,000, but if you post with enough UM/UIM, I have seen many people who pay car insurance premiums for the rest of their lives and take out the remaining compensation.
Additionally, there are many important factors that determine how long the case will be and the amount of compensation, such as what kind of insurance company the other party is, what kind of personality the person in charge has, what part of the car was hit, and whether I have received treatment for injuries resulting from an accident within the last five years. In order to deal with these factors well, the most important thing is to first find a law firm that specializes in traffic accidents based on experience. Just as a law firm specializing in immigration law, a law firm specializing in commercial law, and a law firm specializing in family law are systematically doing well in family law, you can expect much better results if you systematically take your case to a law firm specializing only in traffic accident injuries.
